By accessing or using FancyFace ("the Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Service.

These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

FancyFace provides AI-powered face swap technology for images and videos. The Service allows users to upload media files and apply face swapping using advanced artificial intelligence algorithms.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Responsibilities

You are solely responsible for the content you upload and the face swap results you generate. You must have the legal right to use any images or videos you upload to the Service.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

4. Prohibited Uses

You must NOT use the Service to: create deepfakes for fraud, harassment, or defamation; generate content that depicts minors in inappropriate contexts; produce content that violates any person's right of publicity or privacy; create misleading content intended to deceive or manipulate; generate illegal, harmful, threatening, or discriminatory content; or circumvent any security measures or usage limits.

Violation of these prohibitions may result in immediate suspension of your access to the Service.

5. Intellectual Property

You retain ownership of the content you upload. However, by uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service.

The face swap technology, algorithms, and Service design are the intellectual property of FancyFace and its licensors. You may not reverse engineer, decompile, or attempt to extract the underlying technology.

6. Usage Limits and Quotas

Free tier users are subject to daily usage limits. Usage is tracked via a visitor ID stored in your browser. Exceeding these limits may result in temporary restrictions on your access.

Paid subscribers receive expanded usage quotas as described in their subscription plan. Quota resets occur at the beginning of each billing period.

7. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We do not warrant that face swap results will meet your expectations or be suitable for any particular purpose. The quality of results depends on the quality and characteristics of the input media.

8. Limitation of Liability

To the maximum extent permitted by law, FancyFace shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless FancyFace from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall remain in effect.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.
